1. ACCEPTANCE OF TERMS

By downloading, accessing, or using the Aeterna application ("Service", "App", "we", "us", or "our"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Service. Aeterna provides a digital sanctuary and memorialization platform utilizing artificial intelligence.

2. DISCLAIMER OF PROFESSIONAL SERVICES (MEDICAL & PSYCHOLOGICAL)

CRITICAL NOTICE: Aeterna is a technology platform designed for digital memorialization and personal reflection. IT IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL, PSYCHIATRIC, PSYCHOLOGICAL, OR BEREAVEMENT COUNSELING SERVICES. The artificial intelligence models powering Aeterna ("AI Entities" or "Echoes") generate responses based on probabilistic algorithms and provided context; they do not possess consciousness, empathy, or professional clinical training. If you are experiencing severe psychological distress, trauma, or suicidal ideation, you must immediately contact local emergency services or a qualified mental health professional.

3. USER ACCOUNTS AND SUBSCRIPTIONS

• 3.1 Account Creation: You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to create an account. You are responsible for maintaining the confidentiality of your login credentials.
• 3.2 Echo Tokens and Subscriptions: Aeterna operates on a tiered subscription and token-based system. Subscriptions and token purchases ("Echoes") are processed via third-party payment gateways managed by RevenueCat.
• 3.3 Refund Policy: All payments for subscriptions and Echo tokens are non-refundable, except where explicitly mandated by applicable consumer protection laws (such as the Australian Consumer Law).

4. USER CONTENT AND INTELLECTUAL PROPERTY

• 4.1 Ownership of User Content: You retain all ownership rights to the text, images, and audio data you upload to the Service ("User Content").
• 4.2 License Grant: By uploading User Content, you grant Aeterna a worldwide, non-exclusive, royalty-free license to host, store, process, and transmit such content solely for the purpose of operating and providing the Service to you.
• 4.3 AI Output: Aeterna does not claim copyright ownership over the AI-generated text or interactions ("Output"). You may use the Output for personal, non-commercial memorialization purposes.

5. BIOMETRIC DATA AND VOICE SYNTHESIS

• 5.1 Legal Authority: If you utilize Aeterna's voice synthesis ("Vocal Imprint") features, you must upload audio samples. By doing so, you represent, warrant, and covenant that you possess all legal rights, explicit consents, or familial/executor authority to reproduce and synthesize the voice of the individual depicted in the audio sample.
• 5.2 Prohibition of Malicious Use: You are strictly prohibited from using the voice synthesis engine to create deepfakes of living individuals without their explicit written consent, or for any fraudulent, defamatory, or deceptive purposes. Aeterna reserves the right to terminate accounts and report to law enforcement any suspected misuse of biometric features.

6. THIRD-PARTY INFRASTRUCTURE AND LLMS

Aeterna utilizes third-party infrastructure (including Supabase for secure database hosting) and third-party Large Language Models (including DeepSeek) to process your chat inputs and generate responses. By using the Service, you acknowledge and agree that your chat interactions and provided persona traits will be transmitted to these third parties for processing.

7. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AETERNA, ITS FOUNDERS, DIRECTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO EMOTIONAL DISTRESS, LOSS OF DATA, OR INTANGIBLE LOSSES.

8. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Australian Capital Territory (ACT), Australia, without regard to its conflict of law provisions.
